Welcome to Decorum Taste, a trading name of, and operated by, Yevnig Ltd. For the purposes of this document “Decorum Taste” or “Yevnig Ltd” are understood to refer to the same entity.

By accessing or using our website, you accept these Terms & Conditions. If you disagree with any aspects, you may not access the Website or use its services. Questions regarding these Terms & Conditions may be submitted to us using the contact form on our website.

Accepting Your Order & Our Manual Confirmation

We undertake to provide an effective service when using the Website. Due to the bespoke, customisable, and time-sensitive nature of creating and delivering our beautiful cakes, once your order is submitted online, our ecommerce ordering process requires our manual verification before it is accepted and confirmed by us.

Upon choosing the initial design for your cake, you will select various options to customise it and then complete your order online. On completing the online checkout process and by making payment to submit your order to us, you will be sent a notification email informing your order is being reviewed for confirmation (we will provide an email address for further enquiries related to the order).

You agree by submitting an order and making payment via our website it will first be reviewed and manually confirmed by our dedicated admin team before being accepted.

Please allow us up to 72 hours to confirm your order before contacting us. Please ensure the email address you provide during the checkout process is valid and accessible.

Your order is not confirmed or guaranteed until we have manually confirmed it by email containing the following subject “CONGRATULATIONS – CAKE CONFIRMATION”.

On our approval, we then reserve the first £500 from your order as a non-refundable booking fee, to cover our costs such as order-admin, scheduling of resources, and most importantly, holding your date (potentially prohibiting other clients from booking us), etc… Please see “Returns, Refunds & Cancellation” below for further details.

Please note any automated system messages sent by the Decorum Taste website (i.e. notifications) do not constitute an acceptance of your order.

In the unlikely event we are unable to accept your order for any reason, we will also inform you by email and also refund any monies paid via the same method used to make the payment.

 

Timescales

Due to the nature of our artisan, handmade and specially-created products, a minimum lead time of 3 weeks is required. It shall not be possible to order a cake directly on our website with less than 3 weeks.

If you wish to place an order on our website for delivery or collection of less than 3 weeks, in this case please contact us. In addition to the terms explained above, for short timescale orders we also reserve the right to:

  • Reject the order without reason and refund all monies paid (i.e. if the date is unavailable or our capacity is reached), or,
  • Accept the order, but require an additional short notice turnaround fee.
  • Once we accept the order, changes or amendments are strictly prohibited.

We shall confirm short lead-time orders in our manual confirmation email. In all cases, an order is not confirmed until you receive our manual confirmation email.

 

Delivery

Orders can be collected from our Kitchen at no cost at a day and time agreed during the manual order confirmation stage. Details, including the address for collection will be provided during checkout when you select the collection option.

We also offer personalised delivery to selected postcode locations in London and the South East. All delivery options incur additional cost, advised during the checkout. Be sure to enter the correct delivery location (especially ensure correct details if the event venue). In all cases, during our subsequent email confirmation process, we may request further details such as delivery time, contact name, contact number, etc… which will form part of our agreement to supply your order.

“Delivery” means carriage of the cake until the location advised in the booking – i.e. at an entrance, reception or other convenient ground floor location with easy vehicular access. You may ask for our driver to unpack / place the cake in a specific location within the venue, although this will be at the discretion of the driver and is not part of our formal agreement and is at your risk.

It is not permitted to change the delivery address once the order is confirmed, please see “Amendments” below, on how we may help with a change of delivery location.

It is imperative your order can be delivered and signed-for on the first (and only) attempt for delivery, as we use a specialised personal service that does not offer redelivery. If you, your nominated contact person, or the delivery address is unavailable when our drivers attempt to make the delivery, we will try to call the number provided to explore options for delivery elsewhere nearby, or if you instruct us, can leave the goods with a neighbour, etc… Please note, any alternative delivery option must fall within a strict window of 30 minutes from when our driver arrives. If we can’t get hold of you, or the delivery is otherwise impossible within a period within 30 minutes after the original delivery time, the goods will be taken back to our bakery where you can arrange collection up to 1 day following the original delivery date. Collection costs incurred by you are your responsibility.

If delivery was not successful and the goods are returned to us, they will be available for a period of up to 1 day following the original delivery date. After 1 day following the original delivery date, the goods will be destroyed, and your booking cancelled. In all cases, refunds are not permitted under any circumstances for failure to deliver, or failure to collect.

In the extremely unlikely event of adverse or extreme weather conditions (such as snow or floods) which may make the delivery to the venue inaccessible, or for other unforeseen complexities outside of our control, we cannot be held liable in any capacity. Please see “Liability” below.

 

Amendments

To keep our prices cost-effective and to offer the “ready-to-go” service we are celebrated for, amendments and changes are not permitted without a surcharge. It is therefore imperative that during your online shopping experience with us you choose the cake design, any customisable options and delivery / collection options carefully, as once they are ordered and then manually confirmed by us, your order is booked and scheduled in our system. You may request changes in the short period between submitting your order online and receiving our manual confirmation email.

However we understand sometimes things change, for example, your venue may not be finalised at the time of placing your cake-order, you may request a delivery address change, or the numbers of guests have changed. We will always try to help.

In all cases please note:

  • Changes are not possible within the final 3 weeks before the event date.
  • Refunds for changes that otherwise reduce the original booking value are not accepted.
  • Changes that add complexity or cost are chargeable.
  • All amendments, no matter how minor, incur a minimum change-fee £50.

You may request amendments only in writing (via the email address given in our manual confirmation email) and agreement to undertake amendments are at the sole discretion of Decorum Taste. We shall advise options and costs via email.

 

Returns, Refunds & Cancellation

Returns are not permitted as all goods supplied by Decorum Taste are specially baked, decorated and hand-finished by a team of real people. By their nature of being made from scrumptious fresh edible cake ingredients, our products are strictly time-limited in their life and therefore non-returnable.

On handover, we require a signature as proof of delivery in perfect condition. Should your order be damaged on delivery and before it is signed-for you must report this immediately via email or use the contact number provided in our confirmation email to be considered for refund or redress. Detailed photographic evidence will also be required. Only this case only, a refund may be considered and the value of any refund solely at the discretion of us.

In general refunds (of all monies paid) will only be permitted within the first 72 hours, or until we confirm your order by email.

Should you wish to cancel your order, please write to us immediately at the email address provided at our manual confirmation / acceptance of order. If we are instructed to cancel, further work will cease and the production slot made available to others.

In all cases, the non-refundable booking fee of £500 shall not be refunded. Refund of the remaining balance is on a sliding scale:

  • Up until 3 weeks before the event, we will refund 100% of the balance.
  • For cancellation in the third week before the event we will refund 50% of the remaining balance.
  • For cancellation in the second week before the event we will refund 25% of the remaining balance.
  • Cancellations in the final 1 week before the event are entirely non-refundable.

Please ensure you have adequate insurance in place to cover unforeseen eventualities.

 

Liability:

The liability of Yevnig Ltd. (trading as Decorum Taste) is strictly limited to a maximum of the total monies paid to us in respect to the order. In the extremely unlikely event we must cancel your order, we shall give notice of not less than 3 weeks and swiftly refund all monies paid to us.

 

Allergens

Various “free-from” options are available during the customisation stage of placing your order, which we hope cater for the majority of customers with non-severe food intolerances or allergies. We do not guarantee trace-free due to our facilities handling ingredients and products containing a variety of allergens. We clearly state our goods are not suitable for severe cases of any intolerance or allergy, so please order very carefully. Please see our allergens page for more information.

 

Fresh Flowers

Where you may wish for fresh flowers to be place in or around the cake, it is the sole responsibility of you to procure these and ensure they are safe for food use (i.e. non-toxic). We cannot be held liable for any issues arising from the use of fresh-flowers.

 

Non-Edible Elements:

Depending on the design of the cake, non-edible elements may be present such as dowels (to support the cake, etc…), decoration (wire flower stems, decoration internal structure, etc..), ribbons, etc… Such non-edible elements will be confirmed on handover. Signature of our handover form confirms you (or the signatory) has understood which items must be removed prior to serving.

We are not liable for any harm that may arise from consumption of any non-edible elements, as they must be fully removed before serving. NOTE: Certain “edible” elements, such as dragees are very hard by their nature and so may present a bite-hazard for weak teeth. Therefore, we always recommend removal of decorative elements prior to serving.

Website Availability

Our services provided only to individuals who can be legally bound by contracts under the applicable law.

You must have a valid lawful credit or debit card and a valid email address. Decorum Taste services are only available for credit and debit card types listed on the website. Cash, cheques and other forms of payment are not permitted.

The Website is not intended for children under 18. If you are under 18 years old, you may not place an order online or provide Decorum Taste any personal information.

 

Acceptable use of the Website

Subject to these Terms you may access and use the Website and order online. The following Terms define the acceptable use of the Website. While using the Website you agree to refrain from wilfully, or carelessly –

  • Interfering with or disrupting the functionality of the Website;
  • Disobey or breach these Terms or any other applicable instructions conveyed by Decorum Taste;
  • Violating any applicable laws, statute, ordinance, rule or regulation;
  • Impersonating any person or entity, or making any false statement about your identity, or affiliation with any person or entity;
  • Providing false or misleading credit card details and/or false delivery address when placing an order online;
  • Displaying the Website or any part thereof in an exposed or concealed frame;
  • Linking to certain elements on the Website independently from the web pages on which they originally appear;
  • Email, transmit or otherwise make available any information and materials that infringes third party’s right, including Intellectual Property Rights;
  • Email, transmit or otherwise make available software viruses, Trojan horses, warms and any other malicious application to computers and networks;
  • Email, transmit or otherwise make available any information or material which may constitute or encourages conduct that would constitute a criminal offense or civil wrongdoing or otherwise violets any applicable law;
  • Email, transmit or otherwise make available any information or material which may be deemed threatening, abusive, harassing, defamatory, libelous, vulgar, obscene or racially, ethnically or otherwise objectionable.
  • In addition, Decorum Taste reserve the right to restrict or decline options or requests (such as textual input for cake decoration) that may be deemed threatening, abusive, harassing, defamatory, libelous, vulgar, obscene or racially, ethnically or otherwise objectionable.

 

Fees and Payments

All fees are quoted in GBP (Pound Sterling). Decorum Taste services are only available for credit and debit card types listed on the website. Cash, cheques and other forms of payment are not permitted.

You represent and warrant that you will pay all fees and taxes when requested. Failing to settle your payments may prevent you from further using the Website, notwithstanding any other remedies available to Decorum Taste under the applicable law.

 

Discounts

Please note, and discounts offered are via personalised and tracked voucher codes. It is not permitted to use any voucher code on our website, if you are not the original recipient of it from us directly. In all cases, use of voucher codes is strictly at our discretion. During our manual confirmation following placing your order online, we shall check the validity of voucher codes used. We reserve the right to request an additional payment if the voucher code used is found to have been used contrary to this condition, and we will advise in our manual confirmation email.

 

Privacy

Decorum Taste respects your privacy. Our current privacy policy forms an integral part of these Terms. Given that the privacy policy may change from time to time, it is recommended that you read it periodically. Decorum Taste may publish in public, including on the Website, any communications with you, provided that your personal details will not be made public without your prior consent.

 

Intellectual Property

Our intellectual property rights exist in this Website, including copyrights, trademarks, trade names, patents, trade secrets, work methods and processes of Decorum Taste. These rights apply, among others, to any textual and non-textual information, including images, graphic design, website layout, data and its processing methods, including the Website’s workflow and code.

You may not copy, duplicate, distribute, sell market and translate any information, including trademarks, images, pictures, texts and Website code, without receiving explicit prior consent in writing from Decorum Taste.

Trademarks appearing on the Website (whether registered or not), the name of Decorum Taste and its trademarks as well as the Website’s Domain name – are the sole property of Decorum Taste.

 

Photographic Rights

Decorum Taste reserves the right to take photographs of any of the work it creates, and use them in any form of media (online or print). This may include imagery of customisations, special requests, etc… By sending us imagery, you waive all rights over it and provide us your consent for us to use those images in any manner we require – this may be for marketing purposes on our online platforms, testimonials on our website, or simply used to promote our services to other prospective clients. 

 

Website Changes and Service Availability

Decorum Taste may from time to time change the Website’s structure, layout, design or display, as well as the scope and availability of information and content therein, without giving any previous notice. Changes of this type may result in anomalies or cause inconvenience. You shall not have any plea, claim or demand whatsoever against Decorum Taste ensuing from the introduction of aforesaid changes or from glitches or any kind of failure resulting from their introduction. The Website is depended on different factors such as software, hardware and communication networks of Decorum Taste, its contractors, or suppliers.

 

Termination of Operation

Decorum Taste may at all times, in its sole discretion, terminate the operation of the Website, or any part thereof, temporarily or permanently. Decorum Taste may not give any notice prior to the termination of the Website. At any time, certain content or service may be blocked, removed or deleted without maintaining any backup copy.

You agree and acknowledge that Decorum Taste does not assume any responsibility with respect to or in connection with the termination of the Website’s operations and loss of any data as a result.

 

Amendments to the Terms

Decorum Taste may from time to time change the Terms, including any and all documents, forms and policies incorporated thereto. Changes will become effective as required, or ordered.

You agree to be bound by any of the changes made in the Terms, including changes to any and all documents, forms and policies incorporated thereto. Continuing to use the Website will indicate your acceptance of the amended terms. If you do not agree with any of the amended terms, then you must not use the Website.

 

Disclaimer of Warranty

You acknowledge and agree that this website is being provided for use “as is”, and therefore you will not have any plea, claim or demand on decorum taste in respect of the website’s properties, abilities, limitations or compatibility with your needs. The use of the website is accordingly being made at your sole and whole risk, without warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security or accuracy. Use of information or content obtained from or through the website is at your own risk.

 

Limitation of Liability

Decorum taste, including its officers, directors, shareholders, employees, sub-contractors, agents, parent companies, sister companies, subsidiaries and other affiliates (together “Yevnig Ltd”) will not be liable to the maximum extent permitted by the applicable law, for any direct, indirect, incidental, or consequential damage, or any other damage and loss, costs, expenses and payments, regardless of the alleged liability or form of action, whether in contract, tort or otherwise, including negligence, intellectual property infringement, product liability and strict liability, that may result from, or in connection with the use or the inability to use the website, or from negligent acts, or from the unavailability of ordered items, or from delivery delays, or from any unintentional fault or error made by us, our staff, or from any fraudulent activity or unauthorised use of credit and debit cards, or from any communication with Decorum Taste, regardless of whether Decorum Taste is advised of the possibility of such damages.

 

Indemnification

You hereby agree to indemnify, defend and hold harmless Decorum Taste at your own expense and immediately after receiving a written notice, from and against any damages, loss, costs, expenses, and payments, including reasonable attorney’s fees and legal expenses, resulting from any complaint, claim, or demand, arising from, or in connection with your use of the Website, or your breach of these Terms, or any other terms, rules or regulations applicable to the use of the Website, or the order, shipment and use of the Products.

 

Governing Law, Jurisdiction

These Terms will be governed by and construed in accordance with UK laws.

General

The Terms and Conditions constitute the entire agreement between you and Decorum Taste with respect to the use of the Website and the services therein.

No waiver, concession, extension, representation, alteration, addition or derogation from the Terms by Decorum Taste, or pursuant to the Terms, will be effective unless consented to explicitly and executed in writing by Decorum Taste authorised representative.

The Terms and Conditions will take precedence over all documents, forms and policies incorporated thereto, which may conflict with these Terms, unless specifically indicated in such documents that a certain provision is determined notwithstanding any of the provisions of these Terms.

Failure on Decorum Taste part to demand performance of any provision in the Terms will not constitute a waiver of any of Decorum Taste rights under the Terms.

 

Changes in Ownership

Decorum Taste may incorporate ownership or management of the Website into a separate corporation or transfer ownership and title to the Website to a third party, provided that your rights under these Terms are not impaired by the transfer. In this case, a copy of the details and information relating to you will be transferred to the entity that receives the rights on the website and you hereby give your prior consent to this.

 

No Assignment

Your rights and obligations under the Terms are not assignable. Any attempted or actual assignment thereof by you will be null and void without Decorum Taste’s prior explicit and written consent.

 

Interpretation

The section headings in the Terms are included for convenience only and will take no part in the interpretation, or construing of the Terms. The word “including”, whether capitalised or not, means without limitation.

 

Severability

If any provision of the Terms is held to be illegal, invalid, or unenforceable by a competent court, then the provision will be performed and enforced to the maximum extent permitted by law, and the remaining provisions of the Terms will continue to remain in full force and effect.

 

Survival

The provisions of the intellectual property, disclaimer of warranty, limitation of liability and indemnification sections, will survive the termination, or expiration of the Terms.
